Important information concerning Act 48 requirements

PDE announces grace period for those in first five-year period

As you know, Act 48 requires all educators holding Pennsylvania public school certification to participate in ongoing professional education. Dr. Barnes, Secretary of Education, recently issued a formal announcement concerning a grace period.

All educators must obtain six credits of collegiate study; six credits of continuing professional education courses; 180 hours of continuing professional education programs, activities or learning experiences; or any combination of credits or hours equivalent to 180 hours every five years to maintain active status.

The first five-year period for professional educators currently holding a Pennsylvania Professional Certification began on July 1, 2000, and ends June 30, 2005.

At the four-year mark of the five-year cycle, the law required PDE to give each eligible educator a notice of the number of credits or hours needed to comply with Act 48.

Because PDE did not have current addresses for all educators, PDE originally chose to give this notice in the summer of 2004 via a posting on the PDE web site, supplemented by press releases to newspapers and other media, communications to school districts, teachers unions and other organizations designed to draw maximum attention to the posting.

Since educators were not actually mailed a written four-year notice, beginning in the summer of 2004, as the law required, the Secretary of Education decided to offer a limited grace period to educators who have insufficient Act 48 hours.

In the next few weeks, a letter will be sent to satisfy the due process-notice standards. These letters will be mailed only to those educators (a) for whom PDE has addresses, and (b) who have not yet reached the 180-hour minimum.

Only educators whose compliance period ends on or before April 30, 2006, will receive notice. For those educators whose compliance period ends April 30, this notice will serve as their four-year notice.

Educators whose compliance period ends after April 30, 2006, will receive a separate written notice that complies with the statutory notice requirements. This will serve as the educator's four-year notice and will indicate the number of credits or hours needed to satisfy the educator's Act 48 requirements.

To take advantage of the grace period, educators notified must complete the forms attached to the letter they receive, and return the completed forms to PDE no later than May 31, 2005. Those who submit their forms have until April 30, 2006 to complete the 180 hours of continuing education.

What You Should Do Now:

Verify your current Act 48 records on the PDE website. Your Act 48 cycle is based on the date your Level I certificate was issued – this is noted on your PDE Act 48 record.
